THE STATE'S CIVIL RESPONSIBILITY IN CASES OF DEATHS RESULTING FROM POLICE ACTIVITY

Abstract

ABSTRACT: This article examines the application of the State's civil responsibility regarding damages, including deaths, caused by police officers in the exercise of their duties. Given the complexity of police actions and their impact on individuals' rights to life and physical integrity, this study analyzes state liability through the lens of civil responsibility theories and applicable legislation, seeking to clarify the extent to which the State may be held accountable in these contexts. To this end, a deductive method is employed, based on an analysis of bibliographic, legislative, and jurisprudential sources. Initially, the theoretical foundations of State civil responsibility are discussed; subsequently, the legislation and standards applicable to cases of police violence are analyzed, considering the conditions for the State’s objective or subjective liability.
